Content
A main objective of the labor migration policy was, is and remains the protection of the labor market and the prevention and combating of illegal employment. Regular labor migrants are obliged to have a work permit and it is important to strengthen their position by combating poor working conditions, underpayment, illegality and displacement on the labor market. This protection is also essential for our society. It can be financially beneficial for companies to evade labor laws. The revision of the Wav contains two measures to strengthen the position of the migrant worker/employee, namely the monthly cashless payment of the wages and the optional ground for rejection if an employer has no economic activities. In addition, there are a number of procedural and technical changes. The amendments are intended to provide an arrangement for a flexible and future-proof policy, thereby creating clarity and certainty. The position of employees will also be strengthened and changes will be made to combat unfair competition. First of all, this book contains a general explanation based on parliamentary history. Since this is an amending act, the original text of the act has been included first. The text of the amendment was then included, accompanied by an article-by-article explanation derived from parliamentary history, after which the integral (new) legislative text was included.

About the authors
  • Dr J. (Harry) van Drongelen is an (emer.) associate professor at the Department of Social Law and Social Politics at Tilburg University and a coordinating legislative lawyer at the Ministry of Social Affairs and Employment.
  • mr. ADM (André) van Rijs is a lecturer at the Department of Private Business and Labor Law of Tilburg University.
